You are responsible for ensuring that someone is available to accept delivery at the provided address. If an order cannot be delivered due to customer unavailability or incorrect address information, Pizza Factory reserves the right to charge for the undelivered order.

For pickup orders, you are responsible for collecting your order within a reasonable time after notification of readiness. Pizza Factory is not responsible for the quality or condition of food products that are not collected within thirty (30) minutes of the designated pickup time.

6. Intellectual Property Rights

EVEN IF PIZZA FACTORY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE), PIZZA FACTORY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA FACTORY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you in its entirety. In such jurisdictions, Pizza Factory's liability shall be limited to the maximum extent permitted by applicable law.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law under the applicable laws of the United States.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Pizza Factory will make good-faith efforts to resolve the dispute within thirty (30) days of receiving your written notice describing the nature of the dispute and your desired resolution. If the dispute cannot be resolved informally within thirty (30) days, either party may proceed to binding arbitration as described below.

13.2 Binding Arbitration

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT OR REQUESTS FOR INJUNCTIVE OR OTHER EQUITABLE RELIEF TO PROTECT INTELLECTUAL PROPERTY RIGHTS, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR THE USE OF THE SERVICES, SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES.

The arbitration shall be conducted in the English language. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms, including whether any claim is subject to arbitration. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AND PIZZA FACTORY EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND PIZZA FACTORY EACH WAIVE ANY RIGHT TO A JURY TRIAL AND EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13.4 Time Limitation on Claims

To the extent permitted by applicable law, any claim or cause of action arising from or related to the use of the Services or these Terms must be filed within one (1) year after such claim or cause of action arose. Claims filed after this period shall be permanently barred, regardless of any statute of limitations to the contrary.

14. Term and Termination
